The first is that South Carolina requires legal grounds for divorce, otherwise parties cannot file. Secondly, you must have jurisdiction to file for divorce in South Carolina. Choosing an Approach That Works Best for You
There are a couple of different ways to approach divorce. One is to file when divorce is contested, and obtain a temporary hearing. This is a hearing where ground rules are laid out between the parties and a judge makes temporary rulings on issues like child custody and child support. Parties will investigate each other's financial assets until the divorce hearing. Another approach is to send a settlement agreement offer to the other party and negotiate on an agreement that works best for everyone involved. I go over both the pros and cons with my clients and encourage the best approach for their situation in order to move on with their lives.
Legal Grounds for Divorce
South Carolina is one of the few remaining states that require lawful grounds for divorce. This means that parties may not obtain a divorce unless they cite one of five grounds for divorce:
- One year separation
- Adultery
- Desertion
- Physical cruelty
- Habitual drunkenness (including drug abuse)
