Myrtle Beach Property Division Attorney
Many couples seeking a divorce believe that fighting over every last bit of property is the only way they are going to receive a fair settlement. However, this is generally not true. While some cases do require court intervention, those that reach a solution through negotiations usually best serve the needs of the parties involved. This is due to the fact that rather than a judge determining how property is to be divided, the parties determine it.

Equitable Division of Property
South Carolina is an equitable distribution state. This means that the starting point for property division is 50-50 of all marital property (all property acquired during the marriage). The distribution can deviate from this starting point and is to be divided "equitably" based on factors such as:
- Length of marriage
- Age and health of both parties
- Income and earning potential of both parties
- Child custody
- Retirement accounts, profit-sharing and 401(k) plans
If you suspect that the other party is hiding assets or is not being completely forthcoming about his or her finances, I can investigate this issue and work with the right experts in order to make sure you get the best property agreement possible for your case.
Especially in these hard economic times, many property division cases require creative solutions in order to solve housing issues. If you are facing home foreclosure and are also seeking a divorce, I can help you with finding a solution that works best considering any current economic problems you may be having.
